  • Customers – those who request or receive services including bin-to-curb, bin cleaning, and trash-related services via TrashAssist.com or their Trash Assist account.

  • Trash Assistants – those who provide services through their Trash Assist account or via partner companies.

  • Third-party vendors – those who deliver services through Trash Assist’s platform or integrations.

This policy also governs Trash Assist’s data collections in connection with its services. All persons subject to this notice are referred to as “users.” Trash Assist complies with privacy laws applicable in the locations where we operate, including Rogers, Arkansas, and the greater NWA region.

SMS Privacy Policy

At Trash Assist, your privacy is critically important to us. This policy explains how we collect, use, and protect your information when you opt into our SMS messaging program. By opting in, you agree to the terms outlined here, compliant with the 2024 Telephone Consumer Protection Act (TCPA) and Campaign Registry guidelines.

2. What We Collect

When you opt into SMS, we collect:

  • Phone Number: The number you used to sign up

  • Message Interaction Data: Status, responses, and engagement

  • Consent Records: When, how, and where you opted in (e.g., web form or keyword)

3. How We Use It

Your data helps us:

  • Send texts based on your preferences (service reminders, alerts, etc.)

  • Comply with TCPA and FCC regulations

  • Improve SMS service performance

We do not use your data for unrelated marketing messages.

4. One-to-One Consent

Per FCC rules (March 2024), your SMS consent only applies to Trash Assist. We will never share your consent with third parties or partners.

Message frequency will vary. Message/data rates may apply based on your carrier. Review your plan for full details.

6. Opting Out

  • Text “STOP” to any Trash Assist message to opt out

  • Text “HELP” for assistance

7. Data Sharing & Disclosure

We will never sell or share your personal information for marketing without your explicit consent.

We may share your info with trusted third-party providers only for the following reasons:

  • To deliver SMS/text messages (e.g., telecom providers)

All partners are bound by confidentiality agreements and cannot use your data outside these purposes.

Do Not Call (DNC) Registry Compliance

If your phone number is on the National DNC Registry, we will not send promotional SMS messages unless you have explicitly opted in to receive them.

We take reasonable technical and administrative measures to protect your data from:

  • Misuse

No system is 100% secure, so we cannot guarantee absolute security. That said, we continuously monitor and improve our protections.

  • This includes timestamps, methods of opt-in, and phone numbers

  • These logs are securely stored and may be used to prove compliance

12. Data Created During Use of Trash Assist Services

A. Location Data

  • For Trash Assistants: GPS data is collected when the app is active (foreground or background) to track service routes and optimize logistics.

  • For Customers: If you enable location access, we may use it to confirm service eligibility, map addresses, or estimate arrival times. You can disable this at any time in your device settings.

B. Transaction Information

We collect details about your service usage:

  • Service type (e.g., bin-to-curb, bin cleaning)

  • Dates and times of service

  • Service address

  • Payment history and method

C. Device & Usage Information

  • Device type and operating system

  • App version and performance logs

  • Browser type (if accessed via web)

  • Interaction data (which pages, forms, or buttons you interacted with)

D. Communications Data

We may store:

  • Text/chat messages between customers and Trash Assistants

  • Call logs or recordings (only when clearly stated beforehand)

  • Email interactions with support

13. Data Retention & Deletion

We retain your data only for as long as necessary to:

  • Deliver and improve services

  • Comply with legal obligations

  • Resolve disputes or enforce our agreements

Example retention timelines:

  • Basic account data: As long as your account is active

  • Billing and transaction records: Up to 7 years (tax purposes)

  • Opt-in/opt-out SMS logs: Minimum 5 years (for TCPA compliance)

Account deletion:

After deletion:

  • Some data may be retained to comply with legal, tax, or fraud prevention requirements

  • Deleted accounts cannot be recovered
